Welcome to Heat Safety. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Heat Safety app ("the App"), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. Description of Service

Heat Safety provides:

• Real-time weather data and Wet Bulb Globe Temperature (WBGT) calculations
• Heat risk assessments and safety recommendations
• Location-based weather monitoring
• Push notifications for dangerous heat conditions
• Historical weather data and forecasts

3. User Responsibilities

3.1 Proper Use

You agree to use the App:

• For lawful purposes only
• As a supplementary tool for heat safety awareness
• With understanding that weather data may have limitations
• In compliance with all applicable laws and regulations

3.2 What You Must NOT Do

You agree NOT to:

• Rely solely on the App for life-threatening decisions
• Use the App as a replacement for professional safety equipment or protocols
• Reverse engineer, decompile, or attempt to extract source code
• Use the App for any commercial purpose without written permission
• Remove or alter any proprietary notices or labels

4. Disclaimer of Warranties

4.1 "As-Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of weather data
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement of third-party rights

4.2 Weather Data Limitations

Weather information is obtained from third-party sources (National Weather Service and other providers). We do not guarantee:

• 100% accuracy of temperature, humidity, or WBGT readings
• Real-time updates in all conditions
• Coverage in all geographic locations
• Prediction accuracy for future conditions

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any injury, illness, death, or damages arising from use of the App
• We are NOT responsible for decisions made based on App information
• We are NOT liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App (if any) in the past 12 months

6. Location Data and Permissions

6.1 Location Services

The App requires location access to provide weather data for your area. By granting location permission, you consent to:

• Collection of your GPS coordinates
• Use of location data to fetch weather information
• Local storage of saved locations on your device

6.2 Your Privacy

We do NOT:

• Sell your location data to third parties
• Track your movements or create location histories on our servers
• Share your personal information without your consent

7. Subscription and In-App Purchases

7.1 Pro Subscription

Heat Safety offers optional Pro subscription features including:

• Unlimited saved locations
• Advanced forecasts and analytics
• Priority notifications
• Ad-free experience

7.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase
• Subscriptions auto-renew unless canceled 24 hours before the end of the current period
• Manage subscriptions in App Store account settings

7.3 Cancellation and Refunds

• Cancel anytime through App Store settings
• No refunds for partial subscription periods
• Refund requests are handled by Apple according to their policies

8. Intellectual Property

All content, features, and functionality of the App are owned by Heat Safety and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Create derivative works based on the App
• Use our trademarks without written permission

9. Third-Party Services

The App uses third-party services including:

• National Weather Service (NWS) for weather data
• Apple Maps for location services
• RevenueCat for subscription management

These services have their own terms and privacy policies. We are not responsible for third-party service performance or availability.

10. Updates and Changes

10.1 App Updates

We may update the App to:

• Add new features
• Fix bugs or security issues
• Improve performance
• Comply with legal requirements

We reserve the right to modify these Terms at any time. Changes will be effective:

11. Termination
